Our contract
These Terms and Conditions will apply to the purchase of goods by you. We are Plateau International Limited, whose trading name is Delicario. Your contract with us begins once your order has been placed and we have sent you an Order Confirmation Email. The contract is completed when the goods are delivered. This contract is subject to these Terms and Conditions, as well as our Privacy and Cookie Policy. These collectively constitute the entire agreement between us. These Terms and Conditions apply to sales made by any means, including telephone, email, and online at delicario.com, and will form the basis of any contract of sale between us. Please read them carefully before placing your order as you will be deemed to be bound by them. Nothing in these Terms and Conditions affects your statutory rights, either as a consumer or otherwise.
Payment
All payments for goods must be made when the order is placed. We will not reserve or despatch goods until payment has been received. Ownership of the goods will pass to you when we have received payment in full.
Payment security
We take the privacy and security of your payment and personal details very seriously. Our website uses high-level SSL encryption technology. This protects your existing card account against unauthorised use when you shop with us. To use this service, you must first register with the bank or organisation that issued your card. Once you have registered and created your own private password with your card issuer, you will be prompted automatically at checkout to provide this password each time you make a purchase. We do not have access to your Verified by Visa, Mastercard SecureCode™ or AMEX Safekey password. We will not be liable to you for any losses caused as a result of unauthorised access to the personal and transactional information you provide us with when placing an order, unless we have acted fraudulently or negligently. Please do not send us payment information by email, as we cannot guarantee the security of data sent to us by email.
Prices
Products are invoiced in GBP sterling at the price at the time of your order. Prices displayed on our website include Value Added Tax, which will be applied at the current rate where applicable. Prices may be subject to variation. If there is an error in pricing, we will contact you as soon as possible. You will have the option of reconfirming your order at the correct price or cancelling it. If we are unable to reach you, your order for the incorrectly priced item will be cancelled, and we are not obliged to honour such orders. Delivery charges are additional to the product cost.
Product description
We have made every effort to ensure that the goods displayed on our website conform to the descriptions and photographs. All images are for illustrative purposes only. The colours, specifications, dimensions and descriptions of our products are displayed as accurately as possible, however there may be some variation between the supplied product and the description on the website. We reserve the right from time to time to vary the dimensions, specifications, descriptions and quantities of items displayed on our website without prior notice.
Age restriction
In placing an order with us, you are confirming that you are aged 18 or over. It is illegal to buy alcohol if you are under age or to buy alcohol for someone else who is under age.
Hampers and gift boxes
For hampers and gift boxes, sometimes a listed product may no longer be available. Delicario may substitute a product of equal or greater value than the original product listed, or issue a refund for the product. Where we have substituted a product, you may request to receive a refund rather than accepting the substitute product by contacting us. We will make any refunds made under these Terms and Conditions within 14 days of us receiving the item from you.
Gift messages
A personal gift message can be included with all orders. Special characters and emojis are not possible. Once an order has been placed, it may not be possible to change the wording of any message.
Intellectual property rights
The contents of our website are protected by copyright. Any reproduction of our website content, including graphics, images, audio content and text may result in legal action.
Software
We cannot guarantee that the functions within our website are error-free and will work with all browsers. We cannot guarantee that the operation of our website will not be affected by viruses. We recommend that you use up-to-date virus-checking software.
Fresh foods
Products that require refrigeration, including fresh products contained in some of our hampers and gift boxes, will be delivered using packaging designed to keep the product in good condition until delivery. Upon delivery, it will be your responsibility to refrigerate the fresh foods.
Because they are perishable, fresh foods are excluded from your statutory right to return purchases within the fourteen working day cooling off period.
Cancellations
We aim to despatch your order quickly. Once an order has been placed, it may not be possible to prevent the order from being despatched. Once despatched, we are unable to stop delivery or cancel the order. If you wish to cancel your order, please contact us. If your order cannot be stopped or cancelled, you may return the items to us per your ‘Right to Cancel and Return Purchases’ below.
Delivery within the United Kingdom
You must provide us with a correct address. If no one is available to collect the delivery, a card will be left stating that the delivery was attempted, where the delivery will be held and the options available for re-delivery or collection. If the delivery is not possible a second time, or if the delivery is refused, the items will be returned to us. You will be contacted for instructions. Refunds will not be available in these circumstances.
Coronavirus update: we are currently servicing our customers as usual but current circumstances may cause delivery delays which are beyond our control.
Delivery outside the United Kingdom
Customers who choose to purchase items for delivery outside the United Kingdom do so at their own risk and must comply with the laws of the recipient’s country. Items for delivery outside the European Union (until 01/01/2021) or outside the United Kingdom (from 01/01/2021) may be subject to import duties, taxes and fees. These are levied once the items reach the specified destination. You are responsible for import duties, taxes and fees incurred on your purchases. We recommend that the recipient’s name and phone number are included with the order, as customs authorities may request personal information when inspecting your parcel. Failure to provide this information to customs will result in the parcel being returned. In this instance we are unable to refund the cost of postage and packaging. You are considered the importer and must comply with all laws and regulations of the country in which the items are to be delivered. Cross-border deliveries are subject to opening and inspection by customs authorities. We cannot guarantee that your goods will arrive in the same condition that they were dispatched should they be subject to inspection. Fresh and perishable products are not suitable for shipment outside of the United Kingdom.

Delivery times
We make every effort to despatch items on time. If the items are not delivered within the time that we specify in the Order Confirmation Email, please contact us. Note that delivery times may vary according to availability and any guarantees or representations made as to delivery times are limited to mainland UK and subject to any delays resulting from postal delays or force majeure (e.g. weather) for which we will not be responsible.
Limitation of liability
Save to the extent that we are responsible for foreseeable loss and damage caused by us, to the maximum extent permitted by law, we accept no liability and shall not be responsible for any loss or damage, whether foreseeable or otherwise, including direct, indirect, consequential, special or exemplary damages, however they may arise.
Events beyond our reasonable control
We will not be responsible to you for any delay or failure to comply with our obligations under these Terms and Conditions if the delay or failure arises from any cause beyond our reasonable control.
Alterations to our website and Terms and Conditions
We reserve the right at any time to make changes to these Terms and Conditions, our Privacy Policy and such other policies as we may notify you of. You will be subject to the policies and terms and conditions in force at the time you use the website or place an order from the website or other means. If any of the terms and conditions forming the contract between us are deemed invalid, void or unenforceable for any reason, it will be deemed severable and will not affect the validity and enforceability of the remaining terms and conditions.
Governing law and jurisdiction
These Terms and Conditions are governed by the law of England and Wales.
